1. About Us
WakeOnMAC is a trade name of MA-IT, a company registered in Denmark (CVR: DK42509922), located at Blåhøj Stationsvej 10, 7330 Brande, Denmark. Contact: contact@wakeonmac.com.
2. Acceptance of Terms
By placing an order through our website or using any WakeOnMAC product, you agree to be bound by these Terms & Conditions. If you do not agree, do not purchase or use our products. You must be at least 18 years of age to make a purchase.
3. Products & Availability
All product descriptions, images, and specifications are provided for informational purposes and may be updated without notice. We reserve the right to modify, discontinue, or limit the availability of any product at any time. Prices are listed in USD and are subject to change without prior notice. Applicable taxes and shipping costs are calculated and displayed at checkout.
4. Orders & Payment
All payments are processed securely through Stripe. By placing an order, you confirm that all information provided is accurate and that you are authorized to use the payment method. We reserve the right to refuse or cancel any order at our discretion, including in cases of suspected fraud, pricing errors, or product unavailability. If an order is cancelled, you will receive a full refund.
5. Consumer Warranty (B2C)
For consumers (individuals purchasing for personal, non-commercial use), WakeOnMAC products are covered by a 2-year limited warranty from the date of delivery, in accordance with applicable EU consumer protection laws. This warranty covers defects in materials and workmanship that arise under normal use conditions.
The warranty does not cover:
- Damage caused by misuse, negligence, or unauthorized modification
- Normal wear and tear
- Damage caused by use outside the product's intended purpose
- Damage resulting from third-party hardware, software, or accessories
- Cosmetic damage that does not affect functionality
6. Business Warranty (B2B)
For business customers (companies, organizations, or individuals purchasing for commercial use), WakeOnMAC products are covered by a 1-year limited warranty from the date of delivery. This warranty is strictly limited to defects in materials and workmanship arising under normal, intended use conditions. All other warranties, whether express, implied, or statutory — including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement — are excluded to the fullest extent permitted by law.
7. Warranty Claims
To make a warranty claim, contact us at contact@wakeonmac.com with your order number and a description of the defect. We may request photos, videos, or the return of the product for inspection. If a warranty claim is approved, we will, at our sole discretion, repair the product, replace it, or issue a refund.
8. Limitation of Liability
To the maximum extent permitted by applicable law, MA-IT (trading as WakeOnMAC) and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, revenue, business opportunities, or goodwill, arising out of or in connection with the use or inability to use our products, even if we have been advised of the possibility of such damages.
Our total aggregate liability for any claim arising from or relating to a product shall not exceed the purchase price paid by you for that specific product.
WakeOnMAC products are designed to physically press the power button of compatible Apple Mac mini computers. We are not responsible for any outcomes resulting from the use of our products with incompatible hardware, in unintended configurations, or in mission-critical environments without appropriate redundancy and failover systems in place.
9. Indemnification
You agree to indemnify, defend, and hold harmless MA-IT (trading as WakeOnMAC), its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of our products, your violation of these Terms, or your violation of any rights of a third party.
10. Intellectual Property
All content on this website — including text, graphics, logos, designs, and software — is the property of MA-IT and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any content without our prior written consent.
11. Third-Party Services
Our website and checkout process use third-party services including Stripe (payments), Tally.so (forms), and Google Analytics (website analytics). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party service providers.
12. Force Majeure
We shall not be liable for any delay or failure to perform our obligations where such delay or failure results from circumstances beyond our reasonable control, including but not limited to natural disasters, war, pandemic, supply chain disruptions, government actions, or failures of third-party services.
13. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
14. Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with the laws of Denmark. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the Danish courts. For consumers within the EU, this does not affect your statutory rights under your local consumer protection laws.
15. Changes to These Terms
We reserve the right to update these Terms at any time. Changes take effect upon publication on this page. Continued use of our website or products after changes constitutes acceptance of the revised Terms. We encourage you to review this page periodically.
